Happ Health / Mobil Hastanem ChatGPT App Terms of Service

These Terms of Service govern the use of the Happ Health / Mobil Hastanem application offered within ChatGPT. By connecting to or using the application within ChatGPT, you are deemed to have accepted these terms.

This text applies together with any other terms of use, privacy policies and terms of service that may be applicable on the Happ Health / Mobil Hastanem website and mobile applications. In the event of a conflict, the provisions of this text shall govern solely with respect to use specific to the ChatGPT application.

1. Scope of the Service

The Happ Health / Mobil Hastanem ChatGPT application helps users obtain information through ChatGPT on the following topics:

  • Searching for and listing hospitals.
  • Searching for and listing branches / specialties.
  • Searching for and listing doctors.
  • Viewing available appointment slots.
  • Searching for and listing pharmacies.
  • Listing home healthcare products and services.
  • Obtaining general help and guidance information.

In its initial release, the application is intended solely for viewing information. The application does not create appointments, cancel appointments, take payments, create orders, display patient records, or perform any binding transaction on behalf of the user.

2. Medical Information and Emergencies

The information provided by the application is for general information and guidance purposes only. The application does not replace medical diagnosis, treatment, prescriptions, emergency intervention, or a physician's opinion.

You should consult qualified healthcare professionals for decisions regarding your health condition. In emergency situations or situations posing a risk to life, do not use the ChatGPT application — immediately call 112 Emergency Call Center or apply to the nearest healthcare institution.

3. User Obligations

By using the application, you agree to comply with the following rules:

  • Not to make false, misleading, unlawful requests or requests intended for misuse.
  • Not to use the application for spam, automated bulk requests, security testing, reverse engineering, or denial of service.
  • Not to share other people's personal data, health data, or private information without authorization.
  • Not to rely solely on the information provided by the application as a basis for a medical decision, diagnosis, or treatment.
  • To comply with the ChatGPT and OpenAI terms of use.

4. Availability and Accuracy of Information

Happ Health / Mobil Hastanem does not guarantee that the application will be uninterrupted, error-free, or always up to date. Information on hospitals, doctors, branches, pharmacies, products, services, and appointment slots may change over time.

The results provided by the application are generated based on the data currently available from the connected backend services. For confirmed appointments, products, prices, campaigns, pharmacy duty status, or service availability, verification should be carried out through the official Happ Health / Mobil Hastanem channels, the call center, or the relevant healthcare institution.

5. Relationship with ChatGPT and OpenAI

This application operates within ChatGPT and may be used through the application infrastructure provided by OpenAI. ChatGPT may interpret user requests and invoke the tools offered by the application.

The ChatGPT service provided by OpenAI is subject to OpenAI's own terms of use and privacy policies. Happ Health / Mobil Hastanem has no control over OpenAI's systems, models, service continuity, account management, or the overall experience within ChatGPT.

6. Personal Data and Privacy

The data processed by the application is explained within the scope of the relevant privacy policy. For details of data processing specific to the ChatGPT application, the separately published ChatGPT Application Privacy Policy should also be reviewed.

In its initial release, the application does not request from the user a Turkish ID number, date of birth, payment card information, patient records, reports, prescriptions, or personal health records. If user-authenticated transactions, appointment booking, or payment flows are added in the future, additional authorization, user consent, and the necessary disclosures will be implemented.

7. Intellectual Property

All intellectual property rights relating to Happ Health, Mobil Hastanem, the application name, logo, interface elements, texts, data arrangements, and the service belong to their respective rights holders.

Use of the application does not grant the user any ownership right over any brand, trade name, software, database, design, or content.

8. Prohibited Uses

Use of the application for the following purposes is prohibited:

  • Unlawful, harmful, misleading activities, or activities involving misuse.
  • Attempts at unauthorized access, searching for security vulnerabilities, denial of service, or compromising system integrity.
  • Generating automated queries or heavy traffic that exceeds the application's normal operating limits.
  • Providing false guidance about healthcare services, using a false identity, or making an unauthorized transaction request on behalf of a third party.
  • Unauthorized commercial reproduction, scraping, resale, or creation of a database from the application's results.

9. Limitation of Liability

The application is provided "as is" and "as available." To the extent permitted by law, Happ Health / Mobil Hastanem is not liable for indirect damages, data loss, loss of revenue, service interruption, decisions made based on incorrect or incomplete information, or problems arising from third-party services.

This provision does not eliminate any consumer rights that cannot be limited under applicable law, or any mandatory legal liabilities.

10. Modification or Discontinuation of the Service

Happ Health / Mobil Hastanem may modify, suspend, or terminate the scope, tools, features, data sources, or availability of the application without prior notice.

Material changes to application versions published in the Public App Directory may be subject to re-review under the relevant platform rules.

11. Changes to the Terms

These Terms of Service may be updated from time to time. The current text will be accessible at the URL where it is published. Your continued use of the application after updates means that you accept the current terms.

12. Governing Law

These Terms of Service shall be interpreted as being subject to the laws of the Republic of Turkey. Mandatory consumer law or applicable mandatory provisions remain reserved.
